1. Agreement to Terms
By accessing or using the Gear platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Gear provides a cloud-based booking and business management platform designed for Rental businesses. The Service includes tools for online booking, customer management, operations, marketing, and analytics.
3. Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration. You must be at least 18 years old to use the Service.
4. Fees & Billing
Gear is free for operators — no monthly subscription, no setup fee, no hosting charge. The platform earns through a flat 5% transaction fee deducted from each online rental booking at the point of charge. Phone, walk-in, and manually recorded bookings carry no platform fee. Stripe’s standard processing fees are passed through at cost. All fees are non-refundable except where the underlying booking is refunded; in that case the platform fee is refunded along with the booking.
5. Payment Processing
We use third-party payment processors (Stripe, Square) to handle transactions. By using the Service, you agree to the terms and policies of the applicable payment processor. We are not responsible for payment processor errors or downtime.
6. Your Data
You retain ownership of your data. We process your data only as described in our Privacy Policy. You are responsible for obtaining consent from your customers for data collection and processing through the Service.
7. Acceptable Use
You agree not to use the Service for any unlawful purpose, to infringe on others' rights, to transmit harmful code, to attempt unauthorized access, or to interfere with the Service's operation.
8. Limitation of Liability
The Service is provided "as is." We make no warranties, express or implied. In no event shall Gear be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
9. Termination
We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
10. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
